Privacy Policy for APCOA Web Services
This notice describes how we, APCOA Austria GmbH, Landstraßer Hauptstraße 146/13A, 1030 Vienna, collect, store and process your personal data (pursuant to Art. 13 para. 1 GDPR).
We process your personal data exclusively in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG). Below we inform you about the type, scope and purpose of data collection and use:
1 PURPOSES OF DATA PROCESSING
We process the personal data that you provide to us as a customer, for example as part of a registration or to conclude a contract. The same applies to such processing operations that are necessary for the implementation of pre-contractual measures, for example in cases of personal enquiries about our products or services.
We will process your personal data for the following purposes:
a.) Online orders in the APCOA portal (e.g. long-term car park subscription)
b.) Online booking & payment at P&R car parks in connection with a public transport ticket
c.) Online advance booking in car parks at airports
d.) Customer enquiries
If you give your express consent, APCOA will use the data you provide during and after the existence of contractual relationships to contact you about offers and promotions for marketing purposes by post, e-mail, telephone/SMS, social media channels or apps. You can revoke or deactivate your consent to the processing of your personal data for marketing purposes at any time in your user account.
We collect this data by means of
the data provided by you in the respective online web shop or as part of a personal enquiry
Evaluation of the parking authorisation medium when entering and exiting and at the entrances
Evaluation of the licence plate data when entering and leaving the car park
You provide your personal data voluntarily. The recording of images and licence plate data is indicated at the operating locations with graphic elements and clear written information in accordance with the legal requirements.
2 LEGAL BASIS OF THE PROCESSING
Consent in the context of registration (Art 6 para 1 lit a GDPR)
Contract initiation and fulfilment (Art 6 para 1 lit b GDPR) of the purposes mentioned under point 1 (a to d),
Legitimate interests (Art 6 (1) (f) GDPR), which consist of achieving the technical (in terms of network and information security) and organisational purposes listed above under point 1 (a to d)
Marketing and advertising (Art. 6 (1) (f) GDPR), as we would like to provide you with up-to-date and targeted information about innovations and offers for our online products.
Right to object pursuant to Art. 21 para. 1 and 2 GDPR:You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data which is based on Art. 6 para. 1 lit. f GDPR. We will not process your personal data following an objection unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims (see Art. 21 (1) GDPR). In this case, you must provide reasons for the objection that arise from your particular situation.
3 USE AND TRANSMISSION OF YOUR PERSONAL DATA
If you have provided us with personal data as a user of our website and/or customer, we use this data exclusively to answer your enquiries, to carry out pre-contractual measures or to process contracts and for technical administration.
We will only pass on or otherwise transfer personal data to third parties if this is necessary for the purpose of contract processing or for billing purposes or if you as a user of the website and/or customer have given your prior consent. 4 STORAGE PERIOD
Your personal data will only be stored by us for as long as is necessary to achieve the purposes for which this data was collected or - if there are additional statutory retention periods (e.g. in the German Commercial Code and under tax law) - for the duration of the statutory retention period and if storage is necessary in connection with the enforcement and/or defence of potential legal or liability claims.
The stored personal data will be deleted if you as a user of the website and/or customer revoke your consent to storage, if your data is no longer required to fulfil the purpose for which it was stored or if its storage is or becomes inadmissible for other legal reasons. Data for accounting and bookkeeping purposes are subject to the statutory retention obligation in accordance with the Federal Fiscal Code and are not affected by a request for deletion.
