Privacy policy for the use of the APCOA FLOW digital service

This notice describes how APCOA PARKING Austria GmbH, Landstraßer Hauptstraße 146/13A, 1030 Vienna processes your personal data (pursuant to Art. 13 para. 1 GDPR)

We process your personal data exclusively in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG). Below we inform you about the type, scope and purpose of data collection and use:

1 PURPOSES OF DATA PROCESSING

We will process your personal data for the following purposes

a.) Online booking & payment of parking transactions without a paper ticket at unrestricted parking facilities

b.) Automated processing of parking transactions by means of licence plate recognition (vehicle licence plate = parking authorisation medium)

c.) Automated payment of parking transactions after exit

d.) Display and routing to locations, as well as the memo function of the parked vehicle, provided that location release is activated via the device settings

e.) for processing reserved parking spaces (online booking and payment of reservations)

f.) Monitoring of legally compliant use (e.g. exceeding the permitted parking time)

g.) Tracking misuse (e.g. means of payment not accepted after exit)

h.) Processing customer enquiries and sending customer messages in connection with app use (product improvements, product explanations, instructions for use such as cleaning licence plates in the event of snowfall, etc.)

We collect this data by means of

the data provided by you during registration or ongoing use in the APCOA FLOW app (name, e-mail, licence plate number, telephone number, release of location data, use of app functionalities)
Evaluation of licence plate data when entering and exiting via licence plate recognition
Evaluation of the parking authorisation medium when driving in and out and at the entrances
Image recording, evaluation of the licence plate data
Payment service provider (data on means of payment are stored exclusively with payment service providers)

The provision of your personal data is voluntary. You will be informed of the image recording and the recording of licence plate data in accordance with the legal requirements at the entrance.

We process the personal data that you provide to us as a customer, for example as part of a registration or to conclude a contract. Other personal data such as customer number and IP address are generated or stored during the registration process. The same applies to such processing operations that are necessary for the implementation of pre-contractual measures, for example in cases of personal enquiries about our products or services.

In the event of your express consent, APCOA will use the data provided by you during, but also after the existence of contractual relationships to contact you about offers and promotions for marketing purposes by e-mail, push notification, telephone/SMS, social media channels. You can revoke or deactivate your consent to the processing of your personal data for marketing purposes at any time in your user account.

There is no automated decision-making or profiling.

2 LEGAL BASES OF THE PROCESSING

Legitimate interest (Art 6 para 1 lit f GDPR), which consists of achieving the purposes mentioned above under point 1 a.) to h.).
Consent in the context of registration (Art 6 para 1 lit a GDPR)
Contract initiation and fulfilment (Art 6 para 1 lit b GDPR) of the purposes mentioned under point 1 a.) to h) above

3 TRANSMISSION OF YOUR PERSONAL DATA

For the above-mentioned purposes, your personal data will be transmitted to the following recipients - if necessary

Processors (e.g. call centres, complaint management, IT service providers)
Billing platforms (credit card organisations, payment service providers)
Insurance companies (e.g. in the event of damage)
Debt collection agency, lawyer, courts
Authorities within the scope of their remit
Clients of the car park operator as operator

If you have provided us with personal data as a user of our app and/or customer, we use this data exclusively to answer your enquiries, to carry out pre-contractual measures or to process contracts and for technical administration.

We will only pass on or otherwise transfer personal data to third parties if this is necessary for the purpose of contract processing or for billing purposes or if you as a user of the website and/or customer have given your prior consent. As a user of the app and/or customer, you have the right to revoke your consent at any time with effect for the future.

Right to object pursuant to Art. 21 (1) and (2) GDPR: You have the right to object, on grounds relating to your particular situation, at any time to processing of your personal data which is based on Art. 6 (1) (f) GDPR. We will not process your personal data following an objection unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims (see Art. 21 (1) GDPR). In this case, you must provide reasons for the objection that arise from your particular situation.

4 STORAGE PERIOD

Your personal data will only be stored by us for as long as it is necessary to achieve the purposes for which it was collected or - if there are additional statutory retention periods (e.g. in the German Commercial Code and under tax law) - for the duration of the statutory retention period and if storage is necessary in connection with the enforcement and/or defence of potential legal or liability claims.

The stored personal data will be deleted if you as a user of the application and/or customer revoke your consent to storage, if your data is no longer required to fulfil the purpose for which it was stored or if its storage is or becomes inadmissible for other legal reasons. Data for accounting and bookkeeping purposes are subject to the statutory retention obligation in accordance with the Federal Fiscal Code and are not affected by a request for deletion.

5 YOUR RIGHTS IN CONNECTION WITH PERSONAL DATA
